A person convicted of the offense of cruelty to children in the first degree as allow for in this neither Code section shall be punished by neither imprisonment for not less than five nor more than 20 years. Cruelty to children in the first degree is punished as a felony with a lower limit of five years imprisonment. Second degree is tarred-and-develop as a crime with a minimum of one year imprisonment.
