The U.S. Consumer Product Safety Commission (CPSC) is an independent federal regulatory agency that was developed in 1972 by Congress in the Consumer production Safety Act. In that law, Congress directed the Commission to protect the public against extravagant risks of injuries and ends linked with consumer products.
The CPSC is a sovereign agency that does not report to nor is part of any other section or agency in the Union government. The CPSC is generally headed by three commissioners appointed by the President of the United States and affirmed by the Senate for staggered seven year terms. The commissioners set policy for the CPSC. Although the CPSC is usually three appointed commissioners, the CPSC currently has five appointed commissioners.
The commission has primary duty for instituting mandatory product-safety standards in order to reduce the unreasonable risk of injury to consumers from consumer products. It also has the agency to ban risky consumer products.
Purpose
The purpose of the Consumer Product Safety Commission is to protect the public against unreasonable risks of injury from consumer products; to assist consumers to evaluate the comparative safety of consumer products.
CPSC acts
CPSC works to reduce the risk of injuries and deaths from consumer products by:
1. Growing voluntary standards with industry.
2. Emerging and enforcing mandatory standards; banning consumer products if no feasible standard would aerosol protect the public.
3. Obtaining the recall of products or arranging for their repair.
4. Conducting research on potential product hazards.
5. Informing and educating consumers through the media, state and local governments, private organizations, and by responding to consumer inquiries.
Scope
The CPSC has the authority to regulate the sale and construct of more than 15,000 different consumer products, from trots to all-terrain vehicles, and from barbecue grills to swimming pools. Products not under jurisdiction of the CPSC include those specific named by law as under the jurisdiction of other federal agencies; for example, machines are regulated by the National Highway Traffic Safety Administration, guns are regulated by the Bureau of Alcohol, Tobacco, Firearms, and chemicals, and drugs are regulated by the Food and Drug Administration.
