National Research Development Corporation V Commissioner Of Patents
National Research Development Corporation V Commissioner Of Patents
The National Research Development Corporation case has been significant in clarifying what is meant through ‘manner of manufacturing’ in values of patent applications. It should be noted that the references to the Patents Act in this event refers to the Australian Patents Act 1952 which was later repealed through the presentation of the Patents Act 1990.
Issues
The issue for the court was to determine if this new procedure of weed – killing constituted a ‘manner of manufacturing’ and could therefore be considered a patentable innovation.
